Tulum Fishing does not collect personal information from users, except when they purchase our products, hire our services, and/or request information via telephone, electronic means, or any other applicable method.

The confidentiality and effective protection of our users' information is a priority for us. For these reasons, Tulum Fishing is committed to adequately protecting this information, based on and in accordance with the principles, rights, and obligations established in the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and other applicable regulations, in order to ensure the security, integrity, and privacy of the users' information.

Therefore, and in compliance with the applicable legal framework, we provide you with the following information:

I. Data Controller. For the purposes of this Privacy Notice, German Ortegon Victoria, operating commercially as Tulum Fishing (RFC: OEVG740423HK6 / CURP: OEVG740423HNERCR06), is responsible for the protection and processing of your personal data, as well as the entity in charge of collecting such data. The personal data of the user that, where appropriate, is collected (unless the user specifies otherwise through the means described in this Privacy Notice), will be treated and protected under strict confidentiality by Tulum Fishing and will be used for the following purposes:

IV. Personal Data We Collect from You. Below is a non-exhaustive list of the personal data that Tulum Fishing will collect from its clients in order to fulfill and deliver the contracted services:

  • Identification Data: Full name, address, home, mobile, and/or work telephone, email address, signature, electronic signature, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), place and date of birth, age, and personal references.
  • Patrimonial Data: Corporate name, business line and/or economic activity, and Federal Taxpayer Registry (RFC) for legal entities. (Note: Tulum Fishing does not collect bank account or credit card information through this medium).

V. Data Transfer. Tulum Fishing may transfer your personal data to third parties, whether Mexican or foreign, who provide the necessary services for the fulfillment of the services you contract with us, as well as to its holding companies, subsidiaries, affiliates, or any other company within the same group responsible for such purpose. In this event, Tulum Fishing will adopt the necessary measures to ensure that the persons who have access to your personal data comply with the provisions of this Privacy Notice and the applicable legal framework. We are committed to ensuring compliance with all principles set forth in the guidelines regarding the protection and transfer of your personal data.

The mechanisms implemented for the exercise of your ARCO rights (Access, Rectification, Cancellation, and Opposition) consist of sending a written request to the email address: info@tulumfishing.com. Tulum Fishing will contact you within a maximum period of 20 (twenty) business days, counted from the date the request is received, to inform you of the decision adopted. If applicable, it will become effective within 15 (fifteen) business days following the date on which the response is communicated.

VIII. Revocation of Consent for Processing Personal Data. At any time, our users may revoke the consent they have granted us for the processing of their personal data, so that we cease using it. To do this, you must submit your request in writing via email to info@tulumfishing.com. However, it is important to note that we may not be able to fulfill your request or stop use immediately in all cases, as we may be required by legal obligation to continue processing your personal data.

IX. Changes to the Privacy Notice. Tulum Fishing may modify this Privacy Notice and its practices regarding the handling of your personal information. Any substantial modification that may affect our users will be notified through a publication on our web portals and via email, or through the communication channels provided.

X. Improper Processing of Your Personal Data. If the user considers that their right to the protection of personal data has been violated by any conduct of Tulum Fishing, or presumes that there is a violation of the provisions established in the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), and after their request they have not received a satisfactory response, they may file the corresponding complaint or claim with the National Institute of Transparency, Access to Information and Personal Data Protection (INAI).
